Appeals

Municipal Affairs handles the application and processing of appeal requests for person(s) aggrieved by decisions by Council(s) that fall under Section 42 of the Urban and Rural Planning act, 2000. Regulation 997/96 establishes four Regional Appeal Boards to accommodate sections of the Province. There are three Regional appeal boards:

  • West Newfoundland Regional Appeal Board
  • Central Newfoundland Regional Appeal Board
  • Eastern Regional Appeal Board
  • Appeals from Labrador are heard through the WNRAB

The appeal board, under section 42, will hear appeals based as follows where a council decision is respect to the following:

  • An application to undertake a development
  • A revocation of an approval or a permit to undertake development
  • The issuance of a stop work order, and
  • A decision permitted under this or another act to be appealed to the board

The applicant is recommended to come to Municipal Affairs to register and if this is not possible, send an appeal request to register and file an appeal with the Appeal Board secretary.

Please be aware that some appeals may not meet the validity criteria, therefore it is recommended to speak to the Appeals secretary before making the appeal. Also note that there is a queue of appeals that are pending, and hearings are held on a first come first serve basis. The appellant will be notified of when and where the hearing date will be located, and informational packets will be sent to the jurisdiction, appellant and other interested or affected parties.
